State v. Berry, 254 N.J. 129 (2023)

2023

Marc Yenicag argued before the New Jersey Supreme Court on behalf of amicus curiae ACDL-NJ that Model Jury charge for being a leader of a drug-trafficking network was fundamentally flawed. Although the Court did not adopt this argument, it found that the trial judge's elaborate response to the jury's yes or no question about the elements of the offense was inappropriate, and the defendant's conviction was reversed. Zachary Levy co-authored the brief and CJ Griffin was of counsel.
