ACDL v. Curtis Gartrell, ___ N.J. ___ (2024)

Bruce Rosen argued in the New Jersey Supreme Court that Gartrell did not abandon his suitcase and thus the Court improperly relied on case law regarding abandonment. Although the majority disagreed, Justice Noriega wrote a compelling dissent, calling the majority opinion "a step backward in our jurisprudence." Justice Noriega wrote that flight flaw law enforcement alone could not constitute abandonment.
